Summary of Bay Dingos Terms & Conditions:
A. Costs & Charges:
-
1
An hourly rate is charged to cover the use of the dingo, its machinery, attachments and a Tip truck. The hourly rate commences from when the contractor arrives on site and steps out of the truck and ceases when all equipment has been loaded and the truck is ready to depart. The charge for one hour is $115.00 plus GST. Time is not charged while the operator takes a meal break.
-
2
For transport of equipment to urban sites a flat charge is made within a 20 km radius of Brookfield. Mileage is charged based on the distance to rural sites. The flat charge is $35.00 + GST for urban travel. $1 per km + GST for for every km more than 20km from Brookfield.
-
3
When additional equipment is required such as a plate compactor or chainsaw an additional charge will apply for their hire, fuel and breakages.
-
4
Charges for any materials such as top soil, metal, filling sand and soak rings are additional to the hourly rate.
-
5
When toll roads can be efficiently used to transport spoil to a tip or carry materials Bay Dingos may pass this cost on to the client.
-
6
The cost of implementing relevant traffic management plans and the hire of safety signs and cones will be an extra cost to the client when Bay Dingos has to work on busy roadsides.
-
7
If Bay Dingos is required to work on a Sunday or public holiday a call out fee equal to the hourly rate will apply. This fee may also apply if the operator is called to an urgent job.
B. Health, Safety and Insurance:
-
1
The client should ensure the site is safe by keeping children and animals in a secure area and advising adults to keep clear of the work site. As the dingo reverses often they could otherwise be inadvertently struck by the machinery. The contractor will also take measures to keep the site safe and will cease work if hazards are perceived.
-
2
The client should advise the Bay Dingos operator of any on site hazards e.g. septic tanks that could collapse, unstable walls etc. any toxic chemicals and any dangerous bees, wasps, excitable dogs, bulls etc. Services should be located and marked prior to start of work.
-
3
The client should advise Bay Dingos five working days ahead of the scheduled day of work when there are gas pipes in the area as plans showing their location need to be obtained before work can commence.
-
4
When it is possible for the client to work alongside the dingo then hearing protection must be worn. Protection from dust is also advised in dry summer months.
-
5
Bay Dingos will not remove material that contains asbestos or old fibrolite or work on a site where asbestos materials are uncontained.
-
6
Bay Dingos carries insurance for third party liability but as insurance excesses are high the contractor will emphasize the need to know where underground services are before digging. The client must have all underground services identified and marked before work can commence. Should a service or pipeline be damaged, that was not identified, then it is the client’s responsibility to organize and pay for the repair.
-
7
The client will be responsible for locating relevant boundary pegs to ensure that the work takes place within the defined boundary and/or where permitted by the adjoining owner.
C. Quotes, Estimates etc:
-
1
When an organization such as a trust, school, church or club requires a firm quote for board approval then a written or emailed quote can be provided when time permits. It remains valid for 2 months. Variations on the day that add to the work plan can result in additional charges.
-
2
Free site visits and estimates can be provided for tasks that will take more than a few hours but they are only accurate to within 20% as ground conditions can vary greatly in the Tauranga area. Changes to the specified work will also affect the final cost.
-
3
For small jobs Bay Dingos is able to provide a "guesstimate" over the phone or by email as it is usually uneconomic to do a site visit for a job that will only take an hour or so. The accuracy of this "guesstimate" can depend on how well the job is described.
D. Invoicing and Payment :
-
1
Bay Dingos preferred payment option is to email the client an invoice shortly after job completion then be paid on-line within seven days. With this option the client is also required to supply a valid postal address and phone number. If a mobile number is provided then Bay Dingos may send a text to advise that the invoice has been emailed. If the project is spread over several weeks a progress payment may be required. No credit card facility is available.
-
2
Clients may pay cash on the day when the job is completed. In this case a hand written invoice can be provided. The contractor does not carry change and is not permitted to discount the GST for cash payments.
-
3
Only pre-approved building companies may run a monthly account payable on the 20th of the following month. In this case statements are not routinely issued unless an account falls overdue.
-
4
Overdue accounts will attract an interest/service charge of 2.5% per month compounding. In the event of non-payment all collection costs will be added to the original invoiced amount.
-
5
Materials supplied by Bay Dingos remain the property of Bay Dingo’s until the account is paid in full.
